As the title says really. Not only have I been throught most of it, I have continued to further my knowledge of these subjects since. I have a good knowledge of Debt matters, including dealing with Bailiffs, Creditors, Banks and the County Court System, including matters involving your legal rights. Hi mate, A CCJ will stay on your Credit reference file for six years. Although whereas other debts can be Statute Barred after 6 years and with no contact, CCJs do not come under the Limitations Act and are always owed until settled. By the way, dont listen to any of these Companies that say they can get them removed, or clean up you Credit file. They cannot do anything that you can't do yourself, with regard to checking your file and removing or altering any out of date information. |

Is it true that if you are being pursued by a debt collection agency that you can stop them harrasing you by sending a letter to them asking them to cease and desist immediatley? |

You cant stop them altogether, but if they are calling you by phone, you can write to them and ask them to communicate only by letter. If they continue you can take action under the telecommunications act, tell them this when you write. Also if they do call by phone, you are not obliged to confirm any of your details , as technically, you dont know who they are, it could be anyone calling. This really narks them!! And generally if they are Harrassing you seek legal advice. |

ok my friend has huge debts (over 20k) and a ccj he has had them for over 7 years now if he continues to not pay them what will happen??? oh its not me honest |

The old`I've got a friend one!! Firstly, if it's just run of the mill creditors then not alot really, just loads of letters threating lots of things that they cant do usually. Others such as council tax, inland revenue have alot more powers. Could go into specifics, but would take for ever, if there is anything specific let me know. One point worth noting though, is if the creditor hasnt made contact and no payment has been made within the last six years, it becomes `Statute Barred`. Again will explain more if applicable, but means they can't persue it if it is! Also entries should be removed from your credit reference file after six years, but not many creditors bother doing it, so it is worth checking to see. If they dont take it off, there is a process to sort it. Hope that helps! |

yeah its just creditors not tax or revenue basicly loans from creditcards/finance/and a bank so are you saying it will clear after 6 years?? if i i mean my friend continues to ignore them?? |

If you've already got CCJ's or a poor credit history, then it wont make a difference. Things like mortgages are still available, just slightly higher rates, and bigger deposits sometimes, just depends on individual circumstance really. Lenders tend to target people with bad credit, it means they know they're going to probably make money out of you! |

question for you mate Orange payed £245 into a mate of mines account 2 yeras ago they are now saying he will be cut off if he does not pay it back can they do this ?? or can he offer to pay it back in installments ETC ? thx lee |

Need a bit more info m8. Why was the money paid into his account, and have they made any contact until now for the money? Has he acknowledged that this amount has been paid in? At the end of the day they can cut him off if they wish, and will probably find something in the contract which allows then to, but if he offers a monthly payment I'm pretty sure they will accept, because at the end of the day it would cost them alot of money to take him to court for something that was their mistake in the first place, and at best the court would order him to repay in installments if he could show that he didnt have that amount readily available. Lee, Much the same as before really mate. The only thing he can do if he wants to be a bit awkward is to ask them to provide proof of this money going into his account, and again offer to repay the amount by monthly payments. If he has acknowleged receipt he's probably a bit stuck now to deny it. Ian |

hiya, dont mean to drag up old topics but anyone got any previous of 'salary protection plan' through scottish widows? i have been paying into one for about 2 years and am gonna be made redundant in feb and will of course (if i dont get a job straight away) claim it as it in theory will pay my salary into my bank from their funds. was thinking they will try and say i will have to live off my redundancy payment or say i wont qualify if i have funds above blah blah amount anyway, my plans are to pay the money into my loan account to try and halve my loan balance (about 16k at the mo) then get a job and wit a few months till i redo my loan to new monthly payment figure as i wont be able to redo loan if i have new job or no job as i wont be reliablely employed, if i pay money into bank and they know ive had 7k for example will they pay out or not? if they do im havin a 12 month holiday :) |

My missus works for the enemy, a debt collection agency. My advice to any1 with outstanding debt is to pay it stop being such a C**t :LOL: |
